The Bargaining Committee is pleased to announce that a tentative agreement has been reached concerning the wages hours and working conditions of UWUA Local 369 SEMASS Unit Members and Covanta SEMASS.
Information meetings will be held at Redman Hall at 4:30PM and 7:15PM on April 22, 2010 with the ballot box open from 2:00PM to 8:00PM.
The Bargaining Committee unanimously recommends ratification. The full text of the agreement is here. Copies will also be available soon at your work site, and at the voting location.

NLRB to Seek Injunction against Covanta Energy
The Union was informed yesterday by NLRB Region 1 that the Board’s General Counsel in Washington, D.C. has authorized the Region to pursue an injunction against Covanta in U.S. District Court in Boston. The NLRB invokes the rare procedure only in cases considered egregious enough to warrant federal court intervention.
As you are all aware Covanta’s illegal conduct is the subject of a trial already underway before an administrative law judge, which is set to resume on November 30 in Plymouth. The power of the NLRB to seek injunctive relief comes from section 10(j) of the National Labor Relations Act, which authorizes the agency to pursue injunctions in cases where unfair labor practices have been committed, and where real harm will arise for workers before an administrative trial and appeals can be concluded. The NLRB’s decision to seek a federal court injunction is exceedingly rare. For example, during 2008 the Board authorized only eighteen Section 10(j) injunction requests. According to NLRB data, this represented only 0.22% of the 8,036 cases in which the Board found merit in charges filed with the agency and either issued an administrative complaint or negotiated a settlement.

The Utility Workers Union of America Local 369 is continuing its steady membership growth this spring by bringing about 130 workers at the SEMASS incinerator in Rochester into its fold.
Workers at the incinerator, which is owned by Covanta Holding Corp. of Fairfield, N.J., voted in early May to join the Braintree-based union, according to Local 369 President Gary Sullivan.
Sullivan said he had his first meeting with Covanta management representatives last week to discuss upcoming contract negotiations. Sullivan said he doesn’t expect contract talks to begin for at least a month.
“We laid out the ground rules and what our expectations are,” Sullivan said. “We’re optimistic that the company is going to work to take care of their employees and negotiate a reasonable contract.”
Sullivan said the union is also reaching out to the substantial minority of SEMASS workers who voted against joining the union in last month’s vote.
Sullivan said the union’s membership has steadily grown in the past eight years from about 1,600 members in 2000 to about 3,500 members now, despite a national downward trend in utility sector employment.
“It’s uncertain times in the utility industry,” Sullivan said. “People don’t know what’s going on, and they want some protection.”
Sullivan said Local 369 represents workers at nearly 85 percent of the power plants in the state, although this is the first time that workers at a waste-to-energy incinerator have joined the union. The SEMASS plant isn’t the only incinerator with a union: Vera Carley, a spokeswoman for Covanta, said seven of the company’s 35 waste-to-energy facilities have a unionized work force.
“We recognize and respect our employees right to organize and participate in a labor union,” Carley said of the organizing drive at the company’s SEMASS plant. “We will fulfill our obligation to negotiate in good faith.”
